Temporary pool fence requirements are not uniform across the United States.
Before a pool contractor, distributor, importer, architect, designer or project purchaser selects a temporary pool fence, the applicable state and local rules, permit conditions, barrier layout, gate configuration and installation method should be confirmed with the Authority Having Jurisdiction (AHJ).

We do not assume that a fence becomes locally approved simply because it is 48 inches high, removable, designed for swimming pools or manufactured from a particular material. We start with the project location and confirmed requirements, then translate those requirements into a manufacturable fence specification.
The U.S. Consumer Product Safety Commission (CPSC) publishes widely used residential pool-barrier guidance, but the document states that its guidelines are not a CPSC standard or mandatory requirements and directs readers to check local authorities. For a live project, the adopted code and local AHJ remain essential verification points.
Direct Answer: What Are the U.S. Temporary Pool Fence Requirements?
Start with federal safety guidance and model codes, then verify state requirements, city or county amendments, permit conditions, approved drawings and the final AHJ inspection.

CPSC recommends a barrier of at least 48 inches in its residential guidance. The 2024 ISPSC also contains a model 48-inch minimum barrier height. Model-code language becomes enforceable through the relevant jurisdiction's adoption process, so 48 inches is an important reference point, not an automatic 50-state approval rule.
Do Temporary Pools Need a Fence?
They often need an effective barrier or another required method of restricting access, but the exact answer depends on pool type, water depth, use and jurisdiction. CPSC guidance addresses in-ground, above-ground, on-ground and some portable pools, as well as spas and hot tubs, and recommends controlling access to portable pools.
For an actual project, ask: Does this pool fall within the barrier requirements adopted by the state and local AHJ?
Federal Guidance vs. Local Requirements
One of the most common questions we receive from buyers is: “Is this pool fence U.S. compliant?” From a factory perspective, that question is too broad.
A better question is: “What barrier requirements apply to this specific project, and can the proposed fence system be manufactured and installed to meet those confirmed requirements?”
CPSC Is a Safety Reference, Not a Nationwide Approval Certificate
CPSC guidance discusses barrier height, openings, bottom clearance, climbability, gate direction, self-closing and self-latching gates, above-ground pool access and removable mesh pool fencing. These are useful safety and design references, but project compliance still depends on the rules adopted and enforced for the project location.
The ISPSC Is a Model Code
The 2024 ISPSC includes detailed pool and spa barrier provisions and a model 48-inch minimum barrier height. Jurisdictions may adopt model codes and may amend them. A project specification should therefore identify more than a generic code name.

Removable Mesh and No-Drill Systems

Removable Mesh Fence Considerations
CPSC guidance specifically discusses removable mesh pool fences. It recommends a minimum 48-inch height, support posts extending below grade, limits on post spacing and a small clearance between the mesh bottom and installed surface. ASTM lists F2286-16(2023) as the active removable-mesh fencing specification.
Do not copy these values automatically into every purchase order. Confirm the applicable code, current standard, product configuration, site condition and AHJ requirements.
No-Drill Systems Require a Different Review
A rigid welded-mesh system using surface-supported bases is structurally different from a sleeve-mounted removable mesh fence. We do not represent a no-drill system as removable-mesh fencing merely because it can be moved.
Confirm that the proposed base, support, restraint and gate arrangement are acceptable to the AHJ before production.
Once requirements are confirmed, we can adjust panel dimensions, fence height, mesh configuration, gate design, support components, finish, connections and packaging around the project specification.
Gate and Access Checks
A fence panel can meet the intended dimensional requirements and the overall installation can still fail inspection because of the gate. CPSC recommends that pedestrian pool gates open away from the pool and be self-closing and self-latching.

Why the table does not assign one fence height to every state: a single number creates false certainty. A state may have its own statute, a municipality may amend an adopted code, a permit may impose a project-specific condition, and a temporary construction barrier may be treated differently from the permanent pool enclosure.

Arizona
Arizona shows why a generic 48-inch assumption can be risky. For pools within the scope of A.R.S. §36-1681, the state statute contains a five-foot enclosure requirement plus opening, gate and access-control provisions, subject to its scope and exceptions. Verify the current statute and local requirements.
Phoenix, Arizona
Phoenix publishes city-level ISPSC amendments. For us as a factory, the words “Arizona pool fence” are not enough; we need the project location and confirmed specification.
Florida
Florida Statutes §515.29 includes a four-foot residential barrier minimum and outward-opening, self-closing, self-latching gate provisions. The applicable building code, permit conditions and local AHJ requirements still need verification.
Miami-Dade County
Miami-Dade illustrates the practical sequence of state law and code plus county permit guidance and inspection. Buyers should not stop at the state level.
California
California provides another reason not to market one “U.S. compliant height.” The state Swimming Pool Safety Act and current building standards must be read together with local enforcement and project conditions.
New York
New York is particularly relevant to buyers searching for a temporary fence for pool inspection. The 2025 Residential Code of New York State expressly regulates temporary barriers during pool installation or construction and includes state-specific timing for replacement by a permanent barrier. Do not generalize that timing nationwide.
